ModernWarfare3.com to re-direct to official MW3 web site, any day now

Call of Duty Modern Warfare 3 website

It’s good news for all the fans of the Call of Duty franchise.

The domain name ModernWarfare3.com has transferred over to Activision’s domain server that hosts other names like CallofDuty.com, which likely means only one thing:  ModernWarfare3.com will finally resolve to the official MW3 website any day now.

Earlier in the week, Activision’s trademark attorneys at Millen, White, Zelano & Branigan, P.C, took official control of ModernWarfare3.com from Anthony Abraham following a dispute over the web address.

The transfer of the domain to Activision’s domain server occurred on Saturday, September 24, 2011.

ModernWarfare3.com: Activision’s attorneys take official control of domain

ModernWarfare3.com Whois

In what has been one of the most highly publicized struggles for a domain name, Activision’s trademark attorneys at Millen, White, Zelano & Branigan, P.C, have officially taken control of ModernWarfare3.com from Anthony Abraham as of September 21, 2011, after winning the dispute over the web addresss earlier in the month.

Now all that’s left to do is to transfer the domain to Activision’s Mary Tuck, who serves as the company’s senior litigation counsel (and is the registrant for most of Activision’s properties), then re-direct the domain to the official ‘Modern Warfare 3’ website at callofduty.com/mw3.

Modernwarfare3.com doesn’t resolve to a web page at the time of this story, but lets hope that Activision puts it to good use shortly.

Type in modernwarfare3.com into any of the major search engines, and EA’s Battlefield 3 is still the first result.  A temporary effect of Anthony Abraham’s redirection of modernwarfare3.com to  battlefield.com/battlefied3 back in July.

ModernWarfare3.com domain name battle ends with an Activision triumph

Modern Warfare 3

The domain battle between Anthony Abraham and Activision over ModernWarfare3.com has come to an end.

A three-member panel of the National Arbitration Forum has ordered the domain name transferred.

Earlier this year Anthony Abraham launched an unofficial fan site for Call of Duty: Modern Warfare 3, attracting thousands of Facebook fans in a matter of days.

In late June, Abraham began lashing out at Activision, the publisher of Call of Duty Modern Warfare 3, in a series of statements and videos that appeared on the ModernWarfare3.com website, and throwing support instead to Electronic Arts’ Battlefield 3.

Activision eventually filed a complaint (read here) which revealed the identity of the Battlefield 3 fanboy.

According to the decision posted online, Abraham argued that the term “modern warfare” is generic and is not monopolized by Activision.

Activision was required to prove that modernwarfare3.com is identical or confusingly similar to its trademark, that Abraham has no rights or legitimate interests in respect of the domain; and the domain name has been registered and is being used in bad faith.

The three-member panel ruled in Activision’s favor today, having established all three elements required under the ICANN Policy.

Here is a copy of the decision by the National Arbitration Forum so you can read all the details.

ModernWarfare4.com domain no longer hostage to ZiiP community [Updated]

Modern Warfare 4

The domain name ModernWarfare4.com which grabbed headlines in 2009 seems to have a new home.

The story of ModernWarfare4.com started years ago with a threat to hurt a clown if the game development studio behind Modern Warfare, Infinity Ward, didn’t play ball with the ransom demands of the owner of ModernWarfare4.com — a domain name owned by James Galland (aka Jester) of the ZiiP gaming community.

It ended, with the website (pictured here) featuring the clown and a poll on what to do with the domain finally being taken down earlier this month.

As of August 6, 2011, the web address ModernWarfare4.com is no longer registered to James Galland, and now is hidden behind Whois Privacy Protection Services at ENOM.

Here’s a look at the Whois record:

Domain name: modernwarfare4.com

Registrant Contact:
   Whois Privacy Protection Service, Inc.
   Whois Agent ()

   Fax:
   PMB 368, 14150 NE 20th St – F1
   C/O modernwarfare4.com
   Bellevue, WA 98007
   US

Administrative Contact:
   Whois Privacy Protection Service, Inc.
   Whois Agent ()
   PMB 368, 14150 NE 20th St – F1
   C/O modernwarfare4.com
   Bellevue, WA 98007
   US

Just because the registrant information changed, doesn’t mean the owner changed since the domain is behind Whois privacy.

However, it’s entirely possible that James Galland got spooked by the saga of ModernWarfare3.com.  Activision has a dispute filed with the National Arbitration Forum seeking ownership of the domain ModernWarfare3.com.

It’s also possible Activision acquired the domain by offering money.

I’ve reached out to James to learn more, and will update the story if I hear back.

Updated August 27, 2011:  I received a response from James who still owns the domain name.  The website has been updated since this story was published.  James wrote:

Hi there JB.

Oh my god.. shhh… don’t tell anyone. I went to feed the clown the other night – and I might (I stress might) have left the door unlocked. I came back in the morning and he had gone. All that was left was a note saying “Screw you guys, I’ve had it being a clown – I’ve gone to re-train as a plumber”. I guess the promotion prospects of being a tortured-clown prisoner aren’t enough for some people. Sheesh. His name was Mario though.. go figure.

On a slightly more serious note…

I can happily report that we still own the domain. We have no real interest in profiting from it – was all the clown’s idea.  We’re not freaked out at all by the MW3 site saga as there are worst things happening in the world. Actually: Thanks for highlighting the site being down.. I was playing around with my webserver and must have hit the “turn off joke sites” button by accident.

As for the WHOIS thingy changing, that was ment to be done when I purchased the domain – but someone forgot to turn it on. Not really fussed, but I don’t like paying for something and then not getting it : )

Happy Days,

James

SkylandersUniverse.com: Official site for Skylanders Spyro’s Adventure on the web

Skylanders Spyro's Adventure

[Updated: Skylanders Universe BETA opened in mid-October at http://universe.skylanders.com/ but Activision has failed to re-direct the domain SkylandersUniverse.com to the site at the time of this update.]

**

The upcoming Activision game Skylanders: Spyro’s Adventure set for release on October 16, 2011 in the United States, allows players to connect action figures to the platform of their choice.  The video game and toys will work with consoles including the PlayStation 3, Xbox 360, Microsoft Windows, Nintendo 3DS, and the Wii.

But for those people without a game system, Skylanders will also be playable on the web.

Activision already has an official website that provides details about the game on Skylandersgame.com, but the actual site for playing the web version of the game come October, will likely be SkylandersUniverse.com, according to recent domain registrations.

Activision has been busy registering domain names this past week for Modern Warfare 6 and Black Ops 6, a yet-to-be-announced Call of Duty Elite Founders Program, and now for Skylander’s Spyro’s Adventure.

The domains, all registered on August 16 through its registrar MarkMonitor include: spyrosuniverse.com, skylandersuniverse.com and skylandersspyrosuniverse.com.

References to Skylander’s Universe have been popping up on the web, on UK product order pages for the Nintendo 3DS version of the game.
